By accessing or using Carmaury.com, you agree to be bound by these Terms. If you do not agree, do not use the platform.

Carmaury.com is a marketplace that connects buyers and sellers of vehicles. Funds deposited into your Carmaury account (your "Account Balance") are held in USD and, where applicable, may be applied as a down payment toward a vehicle purchase.

You must be at least 18 years old and legally able to enter into binding contracts to use this platform.

Carmaury.com is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

Carmaury.com is not a party to any transaction between buyers and sellers. We do not sell, own, or guarantee any vehicle listed on the platform, and we are not a dealer, broker, or financing provider.

To the maximum extent permitted by law, Carmaury.com, its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the platform, including but not limited to the purchase, sale, condition, title, or financing of any vehicle.

You acknowledge that all transactions are conducted at your own risk and that you are solely responsible for verifying vehicle condition, title status, seller identity, and any financing or payment arrangements before completing a purchase.

Carmaury.com collects the information necessary to operate your account and process deposits and transactions, including your email address, Account Balance, and transaction history.

Payment processing is handled by our third-party payment provider. Carmaury.com does not store your full card or bank details.

We do not sell your personal information to third parties. Aggregated, non-identifying data may be used to improve the platform.

By listing a vehicle for sale on Carmaury.com, you (the "Seller") agree to these Seller Terms. A listing constitutes a legally binding offer to sell the described vehicle to qualified buyers on the platform.

You represent and warrant that you are the legal owner of the vehicle, have clear and marketable title, and have the legal right to sell it. The vehicle must be free of undisclosed liens, encumbrances, salvage or rebuilt branding, and major mechanical defects not disclosed in the listing.

You agree to provide accurate, complete, and current information including make, model, year, mileage, condition, fuel type, transmission, color, and location. Misrepresentation, omission of material facts, or fraudulent listings are prohibited and may result in removal of the listing and termination of your account.

When a buyer applies their Account Balance as a down payment toward your vehicle, those funds serve as a deposit toward the agreed purchase price. The remaining balance, final sale, title transfer, and any financing are your responsibility to arrange directly with the buyer.

Carmaury.com is not a party to the sale and does not guarantee payment in full, buyer performance, or the completion of any transaction. We are not a broker, dealer, or escrow agent.

You are solely responsible for complying with all applicable federal, state, and local laws governing vehicle sales, including title transfer, odometer disclosure, taxes, and any required inspections or disclosures.

You agree to indemnify and hold harmless Carmaury.com, its owners, and affiliates from any claims, damages, or liabilities arising out of your listing, the condition or title of your vehicle, or your interactions with buyers.

Carmaury.com reserves the right to remove any listing, suspend selling privileges, or terminate accounts at its sole discretion if a listing violates these terms or is believed to be fraudulent or misleading.

Your Account Balance consists of funds you deposit in USD through Base44 Payments (powered by Wix), our third-party payment provider. Your Account Balance may be used to make down payments on vehicles or complete purchases on the platform.

Deposits into your Account Balance are processed securely by our payment provider. You may add funds at any time, even if you are not currently purchasing a vehicle — your balance remains available until you choose to use it.

When you apply your Account Balance as a down payment toward a vehicle, the applied amount is transferred to the seller and the remaining balance, financing, and final sale are handled directly between you and the seller or their financing provider. Carmaury.com bears no responsibility for the outcome of those negotiations or agreements.

Pricing, platform features, and fee structures may change at any time without prior notice.

By purchasing a vehicle or applying your Account Balance toward a vehicle on Carmaury.com, you (the "Buyer") agree to these Buyer Terms. Applying funds from your Account Balance constitutes a binding commitment to proceed in good faith toward purchasing the described vehicle.

You represent and warrant that you are at least 18 years old, legally able to enter into a purchase agreement, and have the financial means to complete the transaction, including any remaining balance beyond your applied down payment.

You acknowledge that funds applied toward a vehicle serve as a down payment only. The remaining balance, financing, title transfer, taxes, registration, and delivery are your responsibility to arrange directly with the seller.

You are solely responsible for independently verifying the condition, history, title status, mileage accuracy, and legal standing of any vehicle before applying your Account Balance or completing a purchase. Carmaury.com makes no representation as to the accuracy of listings.

All sales are considered final between you and the seller once your Account Balance is applied. Disputes regarding vehicle condition or seller performance must be resolved directly with the seller.

Carmaury.com uses cookies and similar tracking technologies to operate the platform, authenticate your session, remember your preferences, and analyze usage to improve our services.

Essential cookies are required for core functionality such as login, wallet access, and secure checkout. These cannot be disabled if you wish to use the platform.

Analytics and functional cookies may be used to understand how the platform is used and to improve features. You may disable non-essential cookies through your browser settings, though some functionality may be affected.

Third-party services, including our payment provider, may set their own cookies to process transactions securely. We do not control these third-party cookies and their use is governed by their respective privacy policies.

Funds deposited into your Account Balance are held in USD and remain available for use on the platform until you apply them toward a vehicle purchase or request a withdrawal.

Once your Account Balance is applied as a down payment toward a vehicle, the funds are transferred to the seller and cannot be reversed by Carmaury.com. Any refund must be negotiated directly with the seller.

You may request a withdrawal of your unused Account Balance back to your original payment method, subject to verification and processing by our payment provider. Withdrawals may take up to 10 business days to process and may be subject to fees as disclosed at the time of withdrawal.

If you believe a charge was made in error or due to unauthorized use of your account, you must notify us promptly. We will investigate in good faith, but are not obligated to reverse completed transactions.

Dealer subscription services may be cancelled at any time. Cancellation stops future billing but does not entitle you to a refund of fees already paid for the current billing period.

Payments on Carmaury.com are processed by Base44 Payments (powered by Wix), our third-party payment provider. By making a deposit, you authorize the payment provider to charge your selected payment method for the full amount shown.

Carmaury.com does not store your full card number, bank account details, or other sensitive payment information. All payment data is handled securely by the payment provider in accordance with PCI-DSS standards.

You authorize us to charge the fees associated with your deposits and purchases, including any applicable taxes. You are responsible for ensuring your payment method is valid and has sufficient funds.

If a payment is declined, reversed, or found to be fraudulent, we reserve the right to suspend your account, reverse applied balances, and pursue recovery of any losses, including through legal means.

All amounts are charged in USD unless otherwise stated. Minimum charge amounts may apply as determined by the payment provider.

Carmaury.com offers dealer subscription plans (Pioneer, Stalker, Apex, and Custom) that enable dealers to list vehicles on the platform. Subscription fees are billed monthly in advance through Base44 Payments (powered by Wix).

Subscriptions automatically renew at the end of each billing cycle unless cancelled by the dealer. You may cancel your subscription at any time through the platform; cancellation takes effect at the end of the current billing period and stops future renewal charges.

Carmaury.com may offer a 60-day free trial of a subscription plan through admin-issued invite codes. Trial subscriptions are free for 60 days from activation, after which the subscription automatically converts to a paid plan at the standard monthly rate unless cancelled before the trial period ends.

Listing limits associated with each plan tier reset at the start of each billing cycle. Listings exceeding the plan's limit will be prevented until the next cycle or until the dealer upgrades their plan.

Carmaury.com reserves the right to change subscription pricing, features, and listing limits at any time. Changes to pricing will apply to the next billing cycle following notice, and you may cancel before the change takes effect.

You agree not to use Carmaury.com for any unlawful, fraudulent, or malicious purpose. The following activities are strictly prohibited and may result in immediate account termination and legal action.

Prohibited activities include: listing vehicles you do not own or are not authorized to sell; misrepresenting vehicle condition, mileage, title status, or history; creating fake or duplicate listings; using stolen or unauthorized payment methods; attempting to manipulate Account Balances or circumvent payment systems.

You may not scrape, copy, reverse engineer, or attempt to access the platform's underlying systems, databases, or code. Automated access for competitive purposes is forbidden.

You may not harass, defraud, or deceive other users; post offensive or unlawful content; or use the platform to transmit viruses, malware, or harmful code.

Carmaury.com reserves the right to investigate and take action against any user believed to be violating these terms, including removing content, reversing transactions, suspending accounts, and reporting to authorities.

All content on Carmaury.com, including the logo, branding, design, text, graphics, and software, is the property of Carmaury Inc. or its licensors and is protected by intellectual property laws.

The Carmaury name, the Carmaury logo, and all related marks and trade dress are trademarks of Carmaury Inc. You may not use the Carmaury name, logo, or any confusingly similar marks without our prior written consent.

You may not copy, reproduce, distribute, modify, or create derivative works from any part of the platform without our prior written consent.

Content you submit, such as vehicle listings and photos, remains your property. By submitting it, you grant Carmaury.com a non-exclusive, royalty-free license to display and use that content for the purpose of operating and promoting the platform.

You represent that you have the right to submit all content you post and that it does not infringe the rights of any third party, including copyright, trademark, or privacy rights.

Unauthorized use of the Carmaury.com name, logo, or any platform content may constitute a violation of intellectual property law and is prohibited.

Carmaury.com is committed to protecting your personal information in accordance with applicable data protection laws, including the Texas Data Privacy and Security Act (TDPSA), the California Consumer Privacy Act (CCPA), and, where applicable, the General Data Protection Regulation (GDPR).

We collect only the information necessary to operate your account and process transactions, including your email address, account preferences, Account Balance, transaction history, and technical usage data.

Depending on your jurisdiction, you may have the right to access, correct, delete, or export your personal data; opt out of the sale or sharing of your data; and withdraw consent for certain processing activities.

To exercise your privacy rights, contact us through the platform. We will respond within the timeframe required by applicable law, typically within 30 days.

We retain personal data only as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Data is then deleted or anonymized.

To the fullest extent permitted by law, Carmaury.com, its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the platform or any transaction conducted through it.

Our total liability for any claim arising out of or relating to the platform shall not exceed the amount you have deposited through the platform in the three months preceding the claim.

You agree to indemnify, defend, and hold harmless Carmaury.com and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the platform, your listings, your transactions, or your violation of these terms.

We are not responsible for the conduct of any user on or off the platform, and we make no guarantees regarding the identity, reliability, or trustworthiness of buyers or sellers.

Carmaury.com integrates with and links to third-party services, including payment processing, insurance providers, and vehicle history resources. We do not control and are not responsible for these services.

Your use of third-party services is governed by their own terms and policies. Carmaury.com is not liable for any damage, loss, or dispute arising from your interaction with third-party services.

Insurance providers linked from the platform operate independently. We are not an insurance broker and receive no commission. Insurance procurement is solely between you and the provider.

Any dispute, claim, or controversy arising out of or relating to these terms or your use of Carmaury.com shall, to the fullest extent permitted by law, be resolved through binding arbitration rather than in court.

Arbitration shall be conducted on an individual basis; class arbitrations and class actions are not permitted. The arbitration shall take place in the State of Texas before a single arbitrator, in accordance with the Federal Arbitration Act (9 U.S.C. §§ 1–16).

Before initiating arbitration, you agree to first contact us in writing and attempt to resolve the dispute informally for a period of thirty (30) days.

Either party may seek injunctive or other equitable relief in a state or federal court located in the State of Texas to protect intellectual property or prevent unauthorized use of the platform.

These terms and any dispute shall not prevent Carmaury.com from pursuing remedies for fraud, intellectual property infringement, or unpaid fees in any appropriate forum.

These terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

You agree that the state and federal courts located in the State of Texas shall have exclusive jurisdiction over any claim that is not subject to arbitration as described above. Venue shall be proper in the county in which Carmaury.com maintains its principal place of business.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Texas Deceptive Trade Practices Act (DTPA): Carmaury.com is a marketplace platform and is not a party to any vehicle sale transaction. Nothing in these terms or on the platform constitutes a warranty, representation, or guarantee regarding any vehicle. To the maximum extent permitted by Texas law, Carmaury.com disclaims all implied warranties, including implied warranties of merchantability and fitness for a particular purpose.

Texas Motor Vehicle Sales: All vehicle sales conducted through the platform must comply with the Texas Occupations Code, Chapter 2301 (Texas Lemon Law), and applicable Texas Department of Motor Vehicles (TxDMV) regulations. Sellers are responsible for proper title transfer under Texas Transportation Code Chapter 501, odometer disclosure as required by federal and Texas law, and all applicable Texas taxes, fees, and registration requirements.

Texas Dealer Licensing: Dealers listing vehicles on the platform must hold a valid Texas General Distinguishing Number (GDN) license issued by the TxDMV under Texas Occupations Code § 2301.351, or the equivalent license in their jurisdiction of operation. Carmaury.com may require proof of licensing before permitting dealer listings.

Money Services: Account Balance funds are held and processed by our third-party payment provider. Carmaury.com does not engage in money transmission as defined by Texas Finance Code Chapter 151. All funds are processed through a licensed payment provider in compliance with applicable Texas and federal regulations.

Texas Consumer Rights: Nothing in these terms waives any rights you may have under the Texas DTPA or other Texas consumer protection laws that cannot be waived by agreement. If you believe you have been the victim of a deceptive trade practice, you may have rights and remedies under Texas law.

You may close your account at any time by discontinuing use of the platform. Any unused Account Balance should be withdrawn before closure.

Carmaury.com reserves the right to suspend or terminate your account, remove listings, and block access to the platform at any time, with or without cause and without prior notice.

Grounds for termination include violation of these terms, fraudulent activity, abusive behavior toward other users, unauthorized access attempts, or any conduct that we determine harms the platform or its users.

Upon termination, all licenses granted to you under these terms cease immediately. You remain responsible for any obligations or liabilities incurred prior to termination.

Provisions that by their nature should survive termination—including liability, indemnification, intellectual property, and dispute resolution—shall remain in effect.

Carmaury.com reserves the right to update or modify these terms at any time. Changes will be posted on this page with an updated revision date.

It is your responsibility to review these terms periodically. Continued use of the platform after changes are posted constitutes your acceptance of the updated terms.

If material changes are made that significantly affect your rights, we will make reasonable efforts to notify you through the platform or your account email.

If you do not agree to updated terms, you must stop using the platform. Any transactions initiated prior to the effective date of a change will be governed by the terms in effect at that time.
